Deal Sourcing Legal Requirements
Property deal sourcing in the UK is subject to legal requirements. Sourcers who introduce buyers to properties for a fee must comply with:
- Estate Agents Act 1979: Anyone who introduces a buyer to a seller for a fee may be acting as an estate agent and must comply with this Act.
- Consumer Protection from Unfair Trading Regulations 2008: All claims about property values, rental income, and yields must be accurate and not misleading.
- The Property Ombudsman (TPO): Sourcers should be registered with an approved redress scheme.
- Anti-Money Laundering: Sourcers must conduct customer due diligence under the Money Laundering Regulations 2017.
- Data Protection: Registration with the ICO and compliance with UK GDPR for handling personal data.
- Professional Indemnity Insurance: Recommended to protect against claims of negligence or misrepresentation.
